TERMS OF SALE
These Terms of Sale form a part of the Terms and Conditions of Use that govern your use of the www.reloom.org website (the “Site”), which is owned and operated by Initiative for Affordable Housing, Inc. (“IAH”). These Terms of Sale set forth the terms and conditions by which purchasers (“You“) may purchase products from IAH through the online or physical store. By purchasing products from IAH, you indicate that you have read and agree to these Terms of Sale.
- Electronic Communications
When you visit the Site or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this Site. You agree that all agreements, notices, disclosures, and any other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
- Your Account
If you use this Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. IAH reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.
- Risk of Loss
This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
- Order Change or Cancellation Policy
You may change or cancel an order any time before it ships. Orders may only be changed or canceled if we receive notice from you by telephone or e-mail before the order ships. To change or cancel an order, call us at 404-299-9979 or e-mail us at [email protected]. If your order has shipped, it cannot be modified. To return an unwanted item that has shipped, you may refuse the package or return it by mailing the item to P.O. Box 885, Scottdale, GA 30079.
- Return and Refund Policy
(a) You may return an item to IAH for a full refund or exchange within 30 days if the item is in like-new condition. To return an item, you may email us at [email protected] with a description of the item and the reason for the return. To return an item, pack your item in the original shipping package, if possible, and mail it to P.O. Box 885, Scottdale, GA 30079 with a description of the reason for the return. For proof of delivery, we recommend that you return items via UPS or insured USPS. Upon our receipt of the returned item in like-new condition, we will credit a refund to the original PayPal account used to purchase the item.
(b) IAH does not take title to returned items until we receive the item from the carrier.
(c) At our discretion, a refund may be issued without requiring a return. In this situation, IAH does not take title to the refunded item.
(d) Some items cannot be returned, including:
(i) Items that are soiled, damaged, or abused;
(ii) Items that have been personalized;
(iii) Items that have already been used or washed
(e) If you received an item from IAH as a gift, we would be happy to exchange your item for another item of the same or lower price. We cannot issue cash refunds.
(f) IAH reserves the right to deny any return or exchange.
- Pricing
Except where noted otherwise, the price displayed for products on our website represents the full retail price listed on the product itself. We cannot confirm the price of an item until you order; however, we do not charge your PayPal account until after your order has entered the shipping process. Despite our best efforts, a small number of the items in our online or physical store may be mispriced. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
- Problems with Order
(a) If an item is delivered to you with damage, please contact us by telephone at 404-299-9979 or email at [email protected] and describe the nature of the damage and whether you want to return the item for a refund or receive a replacement item.
(b) If you receive a wrong item or part of your order is missing, please contact us at 404-299-9979 or [email protected].
- Merchandise Availability
Merchandise availability on our website is not guaranteed. If merchandise is not available by the time your order processes, we will notify you of this via e-mail.
- Product Descriptions
IAH attempts to be as accurate as possible with our product descriptions. However, IAH does not warrant the accuracy, completeness, reliability, or currency of product descriptions or other content of the Site. If a product you purchase from IAH is not as described, your sole remedy is to return it in like-new condition.
- Payment
IAH currently only accepts PayPal. We do not currently accept credit cards, debit cards, personal checks, international wire transfers, Smart Cards, or any other form of payment except PayPal.
- Sale for Personal Enjoyment
IAH offers its merchandise for sale for your personal enjoyment and not for resale. Therefore, we reserve the right to limit quantities and refuse to sell to any person whom we believe may be purchasing for resale.
- Disclaimer of Warranties and Limitation of Liability
ALL PRODUCTS INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU ARE PROVIDED BY IAH ON AN “AS IS” AND “as available” basis, unless otherwise specified in writing.
To the full extent permitted by applicable law, IAH disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. IAH will not be liable for any damages of any kind arising from the products included on or otherwise made available to you through this Site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.
Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.
- Applicable Law
These Terms of Sale and your purchase from IAH are governed by the laws of the state of Georgia, USA without regard to the conflicts of laws principles thereof. You consent to the exclusive jurisdiction and venue of the state and federal courts in Fulton County, Georgia, USA in all disputes arising out of or relating to the use of this Site.
